Booster NIL

As a Booster or Donor What You Need To Know
  • In the state of Texas NIL Agreements are only available to current student-athletes at the school. The student must disclose to the university any proposed NIL contract.
  • It is impermissible to make NIL deals with prospective student-athletes.
  • Student-athletes are not allowed to profit from their NIL when engaged in official team activities. They also can’t receive compensation based on enrollment at Hardin-Simmons or athletic performance at Hardin-Simmons.
  • Hardin-Simmons coaches and athletic staff cannot be a part of arranging NIL activities. This is Texas state law.
  • Student-athletes are not prohibited to earn NIL compensation in exchange for property owned by HSU and are not allowed to use school-owned property (uniforms, travel gear, etc.).
  • Contracts cannot be based on performance or have stipulations that the student competes for HSU.
  • NIL contracts can’t extend beyond the student-athlete’s participation in the HSU athletics program.
  • HSU is partnering with Opendorse to educate our athletes on how to use the NIL program for their benefit and also to teach them of the negative issues associated with NIL deals.
  • All NIL deals must include an action on the student-athletes part. You can’t just give the money. That would be illegal and jeopardize their eligibility.
